the Iraqi Civil Society Organizations)
General Authority
Article 1: Parliament (General Assembly)

1. Establishing a coalition of non-governmental organizations in Iraq called (Parliament of the Iraqi Civil Society Organizations) in which all working civil, volunteer and professional organizations in Iraq participate as (a permanent member), and become the representative member in the legislative and executive work and the General Assembly is a coalition of the commission of the civil society, and the General Center is in Baghdad, Iraq.
2. The Parliament is the legislative and representative of non-governmental organizations and the sole representative of the Iraqi organizations belonging to him in Iraq and it is officially responsible for issuing decisions, recommendations and programs involving civil society organizations and empowers the elected executive Commission to implement.
3. Council of the Parliament is the highest (General Council of Commissioners) and it is elected from the Commissioners permanent members of the organizations and the Council has all the powers of the Parliament and is delegated it, and includes all general coordinators.

The
General Assembly of the Parliament of the Iraqi civil society organizations
convened plenary sessions annually in the presence of majority, where the
decisions, recommendations and the budget and programs would be approved
according to the majority system.

Article II: Board of Commissioners-General
(caucus)

The Supreme Council of the General Assembly of the Parliament of the Iraqi civil
society organizations will be elected in the electoral conference and called
(General Council of Commissioners) and its number (36) general commissioners
members, and includes the general coordinators’ Commissioners for Parliament of
the Iraqi Civil Society Organizations representing the executive and provincial
regulatory coordination offices and the offices of specialist direct execution.
1. (18) General Commissioners from the organizational coordination offices in the governorates elect the members of the Commissioners Council of their organizations in their governorates.
2. (17) General Commissioners elect the members of the Direct Execution Offices in the general electoral Conference.
3. The Chairman of the Iraqi Commission is elected by the General Electoral Conference and it requires obtaining the highest votes in the election in a particular vote for this post.
4. There is a right to all the permanent Commissioners members to nominate and elect for the Commissioners Council in the electoral conference.
5. The Council of General Commissioners is elected every four years in the electoral conferences.
6. The Council of Commissioners every three months for the ratification and adoption of its agenda and its decisions are binding on all members of the Iraqi Commission and its Parliament and all the non-governmental institutions that are belonging to the Council.
7. Council of Commissioners meets every three months for the ratification and adoption of its agenda and its decisions are binding on all members of the ICCSE and the Iraqi parliament and non-governmental institutions belonging to him.
8. All decisions of Parliament and the Council of Commissioners-General and subgroups according to a majority voting system.
9. When a shortfall in the number of members of the Board of Commissioners are mandated members of specialists until the General Conference.
10. Every head of an Iraqi organization who’s got a membership of the Civil Parliament has the right of nomination for the General Commissioners Council in the electoral conference in the province or in the Direct Execution Offices or in the Central Electoral Conference.
11. The vote of a general commissioner (the Province Coordinating Office or the Office of the direct execution) in the General Conference is equal to the number of votes of the organizations that elected him, in the voting and representation, or make decisions and recommendations.
12. It is a legal quorum in the elections or attend meetings only when a majority of registered in the coalition by law in the elections or attend meetings only when a majority of registered in the coalition by law.
Article
III: Membership organizations in Parliament

1. Every registered non-governmental organization, active and have (a responsible body, rules of procedure and declared objectives and programs of action and a real system of financing) or the conditions approved by the Parliament, has the right of the belonging to the Iraqi Civil Society Organizations Parliament as a permanent member.
2. The representation of an organization in the parliament is by one member called (a Permanent Member), who is the president of the organization or authorized member from the Civic Organization and is entitled for the nomination and election of his organization. The Organization may changed him in necessity, and document that.
3. The number of the permanent commissioners’ members in the Parliament is open as belonging organizations and the registration in the parliament.
4. There is no right for members that non-mandated from the organizations to enter the parliament and the connections of the other members are with the executive office.
5. The membership of the organization would be end in the Parliament and the organization is not allowed to continue its work in the following cases:
a) The improvement of the legality of the organization based on evidences.
b) The exploitation of the Organization for personal benefit that harms the reputation of the organization and damages the interests of its members.
c) A judgment rule that prevents the Organization from exercising its activity.
d) A violation of the bylaw or the statement of objectives of or having a conflict with the general law or the interests of the civil society.
e) Illegitimate suspicious activities or support of terrorism or sectarianism in all its forms.
6. The Parliament will cancel the membership of the organizations in previous cases with the decision of the majority of the Commissioners Council or the majority of the Parliament member, and automatically will cancel the authorization and will stop its activities in case the decision were made and the decision must be noticed to all the members.
7. The membership of the General Commissioners Council’s member will be end by the decision of the majority board or when the membership of his organization is ending.
Article IV: Funding for Parliament

Sources of finance and budget for the Parliament are by the responsibility of the executive side (The Iraqi Commission) and submit annually to the Parliament for validation and adoption.
Chapter III
Iraqi Commission for Civil Society Enterprises
Article 1: Foundation
1. The Iraqi Commission for Civil Society Enterprises is established from the elected members of Parliament of the Iraqi Civil Society Organizations of NGOs, which is the General Assembly and the Legislative Representative and authorized by the Council of Commissioners-General of the Iraqi Commission, who leads the Iraqi Commission for Civil Society Enterprises and it is the executive side of the decisions, recommendations and resolutions of the Parliament of the Iraqi Civil Society Organizations.
2. Council of Commissioners-General is the Coordinator and the organizer of the relations between the Parliament of the Iraqi Civil Society Organizations and the Iraqi Commission for Civil Society Enterprises which is the unified command of the Parliament and the Iraqi Commission.
3. The Iraqi Commission for Civil Society Enterprises consists from the Council of Commissioners-General and the formations of provincial coordinators and organizer offices and the offices and the direct execution offices and the bodies and centers associated with it as a representative of the Iraqi civil society organizations, and work to build and develop civil society and it considered as the legitimate representative for the civil society institutions in Iraq belonging to the institutional coalition.
Article 2: Council of Commissioners-General
Council of Commissioners-General is the executive leader mandated of the Iraqi Commission for Civil Society Enterprises and regarded as the only executive and representative side of the coalition of civil society institutions. The Council, through (36) general commissioner, works on the supervision and follow-up, coordination and execution of duties and the key executive tasks in the Iraqi Commission and achieves quarterly meetings every three months and it is the high executive coordinating side in the Iraqi Commission.
The Iraqi Commission
It is the executive delegated side from the Parliament which is responsible for the implementation of decisions, recommendations and representative of civil society institutions and responsible for all the works of all the formations and organizational coordination offices in the governorates and offices of direct execution and networks, bodies and centers associated and it has a legal entity and financial independence and considered as an institutional coalition and represents the belonging non-governmental civil institutes in the international and national forums and in front the state and the law and entitled to open branches and offices of international, regional and national, and its general center is in Baghdad.
Article 3: General Organization
the organization adopted the management adopted and
powers and the structural until the ratification and the amendment at the
general annual conference:
1. The Chairman of the Iraqi Commission: the superior head, and he is responsible of the Iraqi Commission and authorized and mandated to issue instructions and operational decisions and entitled to delegate the powers and assign according to law.
2. The General Center: includes the direct implementation offices and the general departments for the assembly of the center, networks and specialized centers and developmental and operational, economic, scientific, technical and organizational to work for the building of civil society and development of the Iraqi reconstruction and the implementation of the general goals. The formations that are associated to the Iraqi Commission are considered as non-governmental entities in charge of civil society institutions to represent and organize their work and coordinate their efforts with the international forums, national and state institutions.
Executive Authority: Board of Directors of the General Center represents the direct execution offices which is responsible for the realization and implementation of the objectives and programs and contracts and projects for Iraqi Commission run by two commissioners operate according to the laws, regulations and instructions issued by the Iraqi Commission as necessary and the requirements of work and the number of coordinators of the bodies of direct execution are (17), member. The offices are:

1. Office of the Coordination of offices of international, regional and national and branches.
2. Office of Public Administration / registration / follow-up / Accounts / General Management Center.
3. Office of Public Relations / International Cooperation / peace and solidarity.
4. Office and the implementation of engineering projects / grants and financial resources.
5. Office of Public Information / freedom of expression / culture / arts / heritage.
6. Office for Research and Studies / development and training / development the abilities.
7. Office of Development and the Sustainable Development / Environment.
8. Office of Public Policy and Political Participation / democratic development / monitoring elections and the Constitution.
9. Office of humanitarian Affairs / relief and aid / Special Needs / displaced and affected and martyrs.
10. Office of Economic Development and Trade / companies and businessmen / reconstruction.
11. Office of students / sports / youth / operation and the fight against poverty.
12. Office of Human Rights / Legal Affairs / Iraqi minorities.
13. Office of Scientific and Education and Health.
14. Office of Labor Affairs / farm / trade union / professional.
15. Office Iraqi tribes and religious affairs.
16. Office of transparency and the fight against corruption / management development.
17. Office of Women and Children.
3. Offices of Coordination the Structures of the Organizations of Governorates: establish in each Iraqi province an Office of Coordination for the Iraqi Commission supervised by the general Commissioner of the province which he is the general coordinator for the Office of Coordination elected from the civic organizations in the province at the province conference with the supervision by the general center and associated to a management coordinating body consisting of a coordinators and advisers and coordinators of counties and mandates the powers of the General Office , connected with the Iraqi Commission administratively and its work will be done decentralize and retains its independence and its decisions are approved by majority voting system and is a member of the Board of Commissioners adopts allied itself with the number of organizations in his province.

Organizational Points
1. With each General Commissioner in the Council of General Commissioners is associated a (Management Coordinating Body) with advisors and coordinators to manage and implement his work according to his job, specialist or Province from the specialists and the representatives of the organizations if he need.
2. The Iraqi Commission employs a number of Advisors, Coordinators according to its need and their specialties and they are associated to the General Center
Article 4: The Membership
The member of the Iraqi Commission who request for the membership by admitting to belongs to the organization with all its certified documents and he will be informed by two weeks of his application and he will have all the rights and qualities of membership as the following:
1. Authorized Member: represent the NGOs in the Iraqi Commission as the permanent authorized member in the Parliament of the Civil Society Institutions for the belonging organization and will be named as a member wherever he would be described.
2. Association Member: represents and coordinates with the state institutions.
3. Co Member: represents the society personalities in the Iraqi Commission.
4. Honorary Member: represents all the unlisted civic institutions (professional, volunteer and civic) and the distinguished people.
5. Follow up Member: represents all the political, religious and national trends in the Iraqi Commission.
6. Supporter Member: represents the economic entities that support financially the Iraqi Commission.
7. Member of Honor: represents the pioneers, distinctive and honorary members in the Iraqi Commission.
8. The International/Regional Office’s Member: represents the Iraqi staff outside Iraq in the international offices.
9. The Friend Member: represents the Commission members from non Iraqi and the representatives of the Friends of the foreign organizations.
Article 5: The Delegations and Authorizations
1. All the members of the Iraqi Commission have the right to work in the Commission and to participate in its formations and to contribute in its activities and to implement its programs and projects.
2. All the decisions, recommendations and regulations are binding to the members belonging to Iraqi Commission.
3. The members of the Iraqi Commission don’t have the right to participate in similar gatherings, commissions or similar programs without the editorial approval, and the affiliation request to the Iraqi Commission is a legal adoption to that.
4. All the authorized members from the NGOs organizations, exclusively, have the right to get the membership of the Iraqi Parliament of Civil Society, and the participation of other members is by an invitation from the Council of Commissioners as observers or advisors.
5. The acceptance of the request to be a member is in any net, center or office that belongs to the Iraqi Commission.
6. The request of membership from the member is considered as an authorization for the Iraqi Commission and legal pledge of the acceptance of the conditions.
7. The requirements of the membership, dismissed and the exemption apply to all members of the Iraqi Commission as stated in the bylaw.
Article 6: Loss of Membership
The member of Iraqi Commission loses his membership and barred from participating his work in the following cases:
1. Each member who stop his contact with the Iraqi Commission for three months without any legally reason.
2. Each member who takes advantage from his work for personal purposes and damages the reputation of his organization or the reputation of the Iraqi Commission or violated the decision of affiliation.
3. Each member who violated the bylaw of his organization or of the Iraqi Commission, including, (the article 5, paragraph 3) above.
4. When a definitive judicial national or international decision to stop his activities.
5. The membership will be end as the mentioned cases above in article 5 by a decision validated by the Council of Commissioners.
6. The member of the General Council of Commissioners will be dismissed by the ratification of the majority of the Council for the dismissal decision, and the decision is considered finally.
7. The other cases and reasons for the dismissal and cancel the membership are introduced to the Council of Commissioners to make the decision.
Article 7: Finance
The finance of Iraqi Commission is by a certified budget and the system of accounting and financial control adopted in Iraq according and the sources of funding are according to the following stages and programs:
1. The Iraqi Commission is funded by voluntary donations and contributors of the establishers and from the General Council of Commissioners until the availability of official founding resources.
2. The morally and legally donations and national and charitable assistance.
3. The financial support, grants and aid allocated by the UN Organization and its international organizations.
4. The shares of aid and donations and direct support from national and international NGOs.
5. The share of Civil Society and its development programs from the state and the ministries of the state from the state budget and state funds.
6. International funds and donators allocated for the civil society organizations and the programs of reconstruction.
7. The borrowing and subscription and grants from banks, and financial institutions and the share of the transferred taxes to them.
8. The imports o f charities and commercial contracts, projects and achievements of different formations of the Iraqi Commission.
General Provisions
1. The Boards of Managers and the bodies of management coordinators (for the general center and the coordinating offices in the provinces and in the regional international branches) are mandated the follow up, coordination and the management of the formations of the Commission in the early stages, and they are authorized all the powers of work until the holding of elections in all locations responsibilities and then their assignment will be end and the elected will be in charge according to the bylaw.
2. The Iraqi Commission authorizes the Council of Commissioners to order the instructions and decisions to implement and clarify and for the application of the materials that are mentioned in the law, which requires that.
3. The Iraqi Commission submits the request for approval of the modification or addition of materials in the rules of the bylaw to the General Council of Commissioners of Parliament to get the approval of the majority until the holding of the General Conference for final ratification.
4. The Iraqi Commission issues orders and decisions on the formations and delegates powers for the bodies, centers and provincial offices and the administrative coordinating bodies associated with it and issuing regulations and instructions required to work.
5. The chairman of Iraqi Commission mandated tasks and assigning responsibilities and forgiveness for all grades and qualities so that the conduct of the election scheduled for the temporary status and responsibility and be ratified at the regular meeting.
6. The chairman of Iraqi Commission mandated appointment or assignment of Iraqi Commission as an adviser or coordinator of the duty or the jurisdiction of the particular responsibility and work for a certain period to fill a vacancy and the specific duties of the Commissioner-General competent.
7. All the resolutions and recommendations adopted at the Iraqi Commission and its formations according to a majority voting system.
8. The Board of Commissioners public offices and commissions and temporary processed and resolved by the decision of their own.
9. The General Council of Commissioners is mandated to issue regulations and determine the functions of all the formations associated with the Iraqi Commission to the demands of the Iraqi action and implementation is a structural and supplements are complementary to the system and the Law Office of the Iraqi endorse the majority of the members of the Board are final ratification at the General Conference.
